UPDATE ON NEW FOOD SAFETY POLICY – Decree No. 46/2026/NĐ-CP

📅 On January 26, 2026, the Government issued Decree No. 46/2026/NĐ-CP, detailing and guiding the implementation of several provisions of the Law on Food Safety, including specific requirements for ensuring food safety in the production of Health Supplement Foods (HSF).

📍 The Decree systematizes and provides detailed guidance on regulations related to:

  • Registration and declaration of conformity for food products and food additives;

  • Management of production and business conditions;

  • Inspection, supervision, and food traceability;

  • Food labeling and advertising regulations;

  • Responsibilities of organizations and individuals throughout the food supply chain.

📌 Food safety conditions for Health Supplement Food production include:
✔️ Manufacturing facilities must establish and maintain a Good Manufacturing Practices (GMP) quality management system to control the entire process of production, distribution, and circulation, ensuring product quality and consumer safety throughout the shelf life.

✔️ The person in charge of professional expertise must hold at least a university degree in relevant fields (food safety, food technology, nutrition, medicine, pharmacy, etc.) and have practical experience.

✔️ Production personnel must be properly trained in GMP and food safety prior to performing manufacturing activities.

✔️ Documentation and production records must be fully maintained, including process records, quality control documents, and product traceability. Risk control measures must be applied to prevent errors and cross-contamination during production.
