Concept of cosmetics, declaration of cosmetics
– Cosmetics are substances or preparations used to come into contact with the external parts of the human body, including teeth, oral mucosa, hair, nails, etc., for purposes such as cleaning, perfuming, altering appearance, maintaining and protecting them under optimal conditions.
– Cosmetics declaration is the process by which businesses wishing to market cosmetic products must undergo registration procedures with the competent management agency to receive a Cosmetic Declaration Registration Certificate. At the same time, they are also responsible for the quality and safety of the products.
Why is it necessary to register the declaration for the circulation of cosmetics?
To control the situation of goods with unclear origins and quality circulating in the market, the government has enacted laws regulating that cosmetic products must undergo registration for product announcement.
Announcing cosmetic products is a way for businesses to ensure the quality of their products and build trust with consumers. It is also an essential basis for determining the responsibility of the unit in case of risks related to consumer health.
Penalties for not announcing cosmetic products
(According to Article 68 of Decree 117/2020/ND-CP: Regulations on penalties and administrative violations in the health field)
A fine ranging from 20 million to 30 million VND shall be imposed on units circulating cosmetic products on the market that have not been issued a Cosmetic Announcement Registration Certificate by the state agency or the certificate has expired but the business has not re-announced the product
Considerations When Announcing Cosmetic Products
– The business registration certificate must have a suitable industry code for the registered product (wholesale, retail of cosmetics). The Certificate of Eligibility for Cosmetic Production (for domestically manufactured products) is required.
– The ingredients must be declared safe for users, with no prohibited substances in cosmetics, and the concentration of limited substances must not exceed the ASEAN Agreement regulations.

For Imported Cosmetic Products
- Cosmetic Product Announcement Form
- Business registration certificate of the entity wishing to announce the cosmetic product
- Letter of Authorization (LOA) from the manufacturer or owner of the product authorizing the entity or business to be responsible for introducing the product to the market.
- Certificate of Free Sale (CFS) from the manufacturing or exporting country (legally legalized by the consulate, except for cases exempt from CFS as specified in Point a, Clause 1, Article 1, Circular 29/2020/TT-BYT).
- Product testing certificate
- Composition table of the cosmetic product
- Product label sample (Market) and supplementary label.
For Locally Manufactured Cosmetic Products
- Cosmetic Product Announcement Form (2 copies)
- Business registration certificate of the entity announcing the cosmetic product
- Letter of Authorization (LOA) from the manufacturer or owner of the product authorizing the entity responsible for introducing the product to the market (applies to domestically manufactured cosmetics where the entity or business is responsible for introducing the product but is not the manufacturer).
- Product testing certificate
- Certificate of eligibility for cosmetic production.
- Composition table of the cosmetic product
- Product label sample
Timeframe for Cosmetic Announcement
- The completion time for the cosmetic announcement process is within 10-45 days.
- The Cosmetic Announcement Certificate is valid for 05 years. After 05 years, if the business wants to continue marketing the product, the announcement process must be repeated.
