📢 CIRCULAR 12/2026/TT-BVHTTDL: GUIDELINES ON THE LAW ON ADVERTISING AND ITS IMPLEMENTING DECREE

Effective from 05 July 2026, Circular 12/2026/TT-BVHTTDL officially comes into force, providing guidance on several provisions of the Law on Advertising and its implementing regulations.

📌 One of the key highlights of the Circular is the requirement for supporting evidence when advertisements use superlative or exclusive claims such as:

✔ “Best”
✔ “Only”
✔ “Number One”
✔ “Top”
✔ Or other words with similar meanings

Accordingly, organizations and individuals may only use such claims if they possess lawful supporting documents as prescribed by law.

📄 Supporting documents may include:

• Market survey results issued by legally established market research organizations;
  • Results of rankings, evaluations, voting programs, or awards granted by legally established organizations or associations;
  • Awards, titles, recognitions, or other valid forms of acknowledgment;
  • Other lawful documents with evidentiary value as prescribed by applicable regulations.

⚠️ Where supporting documents have a validity period, the advertising content may only be used during the period in which such documents remain valid.
