On December 13, 2023, the Ministry of Health announced a new draft decree on cosmetic management, inviting comments from Ministries, Departments, Agencies, and relevant organizations and businesses. This decree was drafted urgently to address issues and loopholes in cosmetic management, more than 12 years since Circular No. 06/2011/TT-BYT and 7 years since Decree No. 93/2016/NĐ-CP.
Six notable changes in this Draft Decree:
1️⃣ Addition of regulations for GMP Certificate or equivalent certification for imported cosmetic dossiers. The draft states that adding a GMP Certificate or equivalent certification for imported cosmetic dossiers is necessary.
2️⃣ Adjustment to reduce the validity period of the cosmetic product declaration receipt number.
Currently, in ASEAN countries, the validity period of the cosmetic product declaration receipt typically lasts from 1 to 3 years. In contrast, in Vietnam, the validity of the cosmetic product declaration receipt extends up to 5 years. Proposing to shorten the validity of the cosmetic product declaration receipt is seen as a reasonable measure to strictly control the declaration of cosmetic products, in line with the actual needs of businesses.
3️⃣ Streamlining administrative procedures related to cosmetic advertising and improving post-market inspection work. The draft decree proposes to eliminate the procedure for confirming cosmetic advertising content, instead setting clear regulations on advertising being consistent with the content declared in the declaration receipt and the nature of the product.
4️⃣ Clarifying the authority to issue the Certificate of Free Sale (CFS) in the country of production/export to ensure consistency with the Foreign Trade Management Law.
5️⃣ Enhancing the verification of the legal status of the owners of imported cosmetic products through authorization letters. The draft will introduce measures to more clearly verify the legal status of the owners in the cosmetic import dossiers.
6️⃣ Improving the application of information technology in cosmetic management.
