Regulations on advertising for Health Supplement

Advertising is a crucial activity for businesses aiming to increase awareness and positive impressions of their products among consumers, ultimately boosting sales. However, to control widespread and misleading advertising that may impact consumers, the government has issued legal regulations to tighten the advertising activities for health supplements. According to these regulations, businesses can only advertise health supplements when granted advertising certificates by the authorized agency.

Therefore, before proceeding with advertising, entities should thoroughly understand the legal regulations concerning advertising activities to submit the required documents correctly and in compliance with the rules.

Legal basis/legal document :

  • Decree No. 15/2018/NĐ-CP, which details the implementation of certain provisions of the Food Safety Law.
  • Decree No. 181/2013/NĐ-CP, providing detailed guidelines for the Advertising Law.
  • Advertising Law (No.: 47/VBHN-VPQH).
  • Circular No. 09/2015/TT-BYT, regulating the confirmation of advertising content for products, goods, and services under the management of the Ministry of Health.

Key regulations to note when advertising Health Supplement:

Conditions for advertising Health Supplement:

– The health supplement  must have been granted an announcement registration certificate by the Department of Food Safety.

Content requirements for Health Supplement advertising 

  • Product name: “Health Supplement” + product name.
  • Name and address of the entity responsible for placing the product on the market.
  • Main functions and any potential side effects (if any).
  • Mandatory note: “This product is not a drug and does not substitute for medicinal treatment.”

Note: Health Supplement should not be advertised in a way that might be misunderstood as a drug. Advertisements in newspapers or images must clearly display the mentioned content.

Regulations regarding advertising documentation for health supplement 

a) Application form confirming the intended content for advertising the product.

b) Registration certificate for the product announcement and the product announcement document (confirmed by the authorized agency).

c) Product label sample (approved by the agency issuing the registration certificate for product announcement).

d) In the case of advertising in newspapers or images, a script and the expected advertising content (recorded on video or audio discs) are required. For advertising on other media, a template of the expected advertising content (with confirmation from the entity wishing to advertise the product) is necessary.

Authority receiving the application and processing time:

Competent authority: 

The Department of Food Safety will receive and issue the certificate confirming the advertising content for products.

Processing time: 

Within 10 working days (excluding Saturdays and Sundays) from the date of receiving a complete and valid application, the authority will review the documentation and provide results to the advertising entity if the application complies with regulations.

In case the documentation needs modification or supplementation, the receiving authority must provide a written response (specifying the reasons and legal basis for requesting modifications or additions) to the business for necessary amendments. Within 10 working days from the receipt of the amended documentation, the authority will review and respond in writing to the advertising entity.
